Doing What’s Best for You
At Childs & Childs, we strive to protect your clients’ wellbeing, and sometimes that means settling outside of court. Litigation, although necessary at times, is time-consuming, costly, and often results in bad feelings between two parties. We offer civil mediation services designed to help disputants arrive at mutually beneficial solutions without having to go to court.
Mediation is a form of Alternative Dispute Resolution (ADR) in which a neutral third party (the mediator) facilitates discussion and negotiation among two or more disputing parties to help them achieve a settlement. Mediators use techniques that improve dialogue and empathy between disputants, but mediators do not make rulings or force settlements upon the parties. The decision to settle is left entirely to the disagreeing parties.
Anytime you need to resolve a dispute, mediation can help. You do not need a lawyer, and your dispute need not involve legal matters.
There are several benefits to using mediation:
- Cost: Mediation can resolve disputes outside of court, preventing expensive legal fees.
- Control: If your dispute goes to court, neither party has control over the outcome. Mediation gives you the control over when and how to settle.
- Confidentiality: With very limited exceptions, mediation is a confidential process. Mediators cannot be called to testify in court, and what happens during mediation cannot be used against the parties in court.
- Time: Court cases can take months or years , but a mediator can help disputing parties find a solution in as little as one day.
